Privacy policy
This is the policy for the protection of personal data, the making and use of audio, visual or audio-visual recordings or other expressions of personal nature relating to a person participating in a ČEZ RunTour race (hereinafter referred to as the "Policy").
This Policy sets out how we use and protect your personal information that is submitted to us through your registration and participation in races and events of the ČEZ RunTour running series ("RunTour"), whether through this website www.run-tour.cz ("Website") or otherwise.
The personal data administrator is the organizer of the RunTour event, VMLY&R s.r.o., with registered office at Bubenská 1477/1, Holešovice, 170 00 Prague 7, ID 26133113 (hereinafter referred to as the "Administrator"). The Administrator undertakes to ensure the security of your personal data. All your personal data may only be used in accordance with this Privacy Policy.
The Policy also regulates how we make and use audio, visual or audio-visual recordings relating to you on the RunTour.
By providing the Administrator with your personal data, you consent to the processing and management of the data provided by you in connection with your participation in RunTour events for the purposes and under the conditions set out below. All personal data we receive from you will be collected, stored and used in accordance with applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, hereinafter referred to as the "Regulation") and Act No. 110/2019 Coll., on the processing of personal data, as amended (hereinafter referred to as the "Act").
Personal data is information that can identify you as a living individual, either by itself or in combination with other information.
The Administrator may collect and process this personal information about you:
- Identification Data, this data includes, but is not limited to: first name, last name, username, title, date of birth, photograph, race numbers, age, gender, professional affiliation, membership of sporting organisations/clubs;
- Contact details, these details include in particular: mailing/billing address, email, telephone number, social media profiles;
- Payment and transaction data includes in particular: banking and payment data, history of orders, payments and receivables;
- Technical data, this data includes in particular: information about your visits to the Website and the sources from which you accessed the Website (more in the Cookies section);
- Profile Data, this data includes, in particular: your account access password and order history, your interests, preferences, feedback, RunTour race results, time and points scores, history of your interaction with us;
- Marketing Data includes but is not limited to: your preferences in relation to marketing materials from the Administrator or RunTour partners and your preferred method of communication.
We may also process your special data (such as data about your race or ethnicity or data relating to your health), but only if you provide it to us and to the extent necessary to enable you to participate in a RunTour race.
Generally, we collect and receive personal information directly from you as a result of your interaction with us and as a result of your participation in events or purchase of goods and services from us. Technical data may be collected by your visit to the Website in the manner described in the Cookies section.
You acknowledge that refusal to provide personal data in cases where the provision of personal data is necessary for the conclusion and performance of a contract between us or in cases where we are obliged to process your personal data for the performance of a legal obligation imposed by us, may result in the failure to conclude our contractual relationship.
The legal titles allowing us to process your data:
We only use your personal data where we are permitted to do so under the relevant legislation and where we have the appropriate legal authority to do so.
In particular, the Administrator uses the following legal titles for data processing:
- when the data processing is necessary for the performance or negotiation of a specific contractual obligation between you and the Administrator (for the provision of a service or the sale of goods);
- for reasons of legitimate interest of the Administrator, where the interest of the Administrator outweighs the legitimate interests and fundamental rights and freedoms of the subject whose data are processed;
- the fulfilment of a legal obligation on the part of the Administrator.
In most cases, the Administrator is not obliged to require consent to process your personal data, except for the purpose of sending their own direct marketing content or direct marketing content of third parties via email or SMS messages.
The purpose for personal data processing:
- We use your identification, contact, transactional and profile data for the purpose of your registration, participation at any of the RunTour races or events. We use this data for the performance of the contract and on the basis of our legitimate interest (to enable you to participate in the race);
- We use your identification and contact data for the purposes of providing video footage or photographs of the RunTour race and for the purpose of announcing race results. We use this data based on our legitimate interest (it is our interest to document the course of the race and RunTour events, to record the results and evaluation of our races, to make announcements of winners, to store the data in case of complaints, to keep statistics). The processing time is unlimited.
- We use your identification, contact, transactional and profile data for the purposes of your purchase, including the purchase of additional services and goods. We use this data for the performance of the contract and on the basis of our legitimate interest (to provide you with the goods and services you have ordered, to offer similar services and goods that may be of interest to you, to prevent fraudulent practices, in an effort to prevent and avoid breaches of our contractual Terms and Conditions, for the purpose of recovering any claims and to ensure the protection of our legal rights) and to comply with our legal obligations (in particular, to comply with tax, payment and statistical obligations). The processing period is defined by the duration of the specific contractual relationship and subsequently for the duration of the statutory limitation periods, at most in this case for a period of 10 years from the date of execution of the respective contractual relationship or the expiry of another statutory archiving period.
- We use your contact, profile, technical and marketing data for the purposes of sending you marketing communications about products and services, enabling you to participate in promotional competitions and marketing events, and to ensure the most effective way of presenting the content of the Website. We use this data on the basis of our legitimate interest (it is our interest to keep business statistics and evaluate the purchasing behaviour of our customers, to improve our Website and services) or on the basis of your consent.
- We use your identification and contact data for the purposes of our communications and to enable you to exercise your rights in relation to data protection. We use this data on the basis of our legitimate interest.
- If you participate in a RunTour race or event as our partner or sponsor, we use your identification, contact, transaction, profile and marketing data. We use this data for the performance of the contract between us, based on our legitimate interest (in order to cooperate with you and to approach you with offers of cooperation) and to fulfil our legal obligations (in particular to fulfil our tax, payment and statistical obligations).
- If you participate in a RunTou race or event as a volunteer, we use your identification, contact and transaction information. We use this data for the performance of the contract and based on our legitimate interest (to engage you as a volunteer).
The personal data is retained for the period speciefied above, always for the time necessary to carry out the above specified purposes and/or for the time necessary to ensure our compliance with the relevant legal obligation or to ensure the protection of our rights.
Direct Marketing
The Administrator's Marketing Offers
Your identification, contact, technical data, profile and marketing data may be used by the Administrator for the purpose of evaluating what is relevant to you and of interest to you based on the legitimate interest of the Administrator, provided that you have not rejected the direct marketing offer. You may object to the processing of your data for direct marketing purposes at any time and your personal data will no longer be processed by the Administrator for that purpose.
Third party marketing offers
We may provide your personal data for direct marketing purposes to other companies that we work with to help us organise and host attractive and high quality RunTour races and events (further referred to as "Partners"), provided that we obtain your consent to do so. A list of Partners is always provided on the Website. This list may be updated. You may unsubscribe from receiving commercial communications electronically at any time.
Personal data of children
In certain cases, the Administrator may process the personal data of children under the age of 13 for the following purposes only: for the purposes of registration and participation of the child in the RunTour race or event, for the evaluation of the race or event and for the documentation of the race or event (photo/video recording). In this case, the Administrator processes only the necessary identification data of the child. The consent of the child's legal representative is always required for the processing of the child's personal data.
Emergency contact
The Administrator may in certain cases process the personal data of third parties - emergency contacts - in the scope of name, surname, telephone number, email address, and does so only for the following purposes: for the purpose of contacting a close person of the participant in the event of an emergency during the race. In this case, the Administrator shall only process the identification data voluntarily provided by the data subject and shall immediately inform the contact person concerned of the processing of these data via email and request consent for further processing.
Cookies
We can collect information about cookies on the user's end device and other similar technologies such as local browser data storage or help centre.
A cookie is a small text file that the browser stores on the user's end device. Cookies often contain an anonymous, unique identifier that allows us to identify and count browsers that visit our site. Cookies also allow us to collect information about how and when the services are used: for example, which page the user accessed our services from, when and what the user is viewing on the Website, which browser the user is using, what the screen resolution is, what the operating system is, the IP address of the user's terminal, and the serial number. Cookies also provide the user with the ability to not enter a username, password and personal customization each time.
Cookies do not move on the network themselves; they are only assigned to the user's terminal by the website that the user loads. Only the server that sent the cookies can read and use them later. Cookies and similar technologies do not damage the user's terminal or files, nor can they be used to run programs or spread viruses.
Users cannot be identified by cookies or other technologies alone, and the Website cannot know, for example, a user's e-mail address unless the user has provided it to us. Subject to the privacy laws and policies of each service, information received from cookies and other similar technologies may be combined with any other information obtained from the user by other means.
Cookies and similar technologies are used to analyze and further develop our services so that we can provide a better service to our users.
Where we store your personal data
Your personal data is stored on secure servers in the IT systems of the Administrator in the Czech Republic. Personal data is collected, processed and stored by the Administrator in the Czech Republic and is not transferred to other countries, unless expressly stated otherwise.
Security
We are committed to ensuring the security of your personal data. To prevent unauthorized access or disclosure, we have put in place appropriate physical, electronic and managerial procedures to protect and secure the information we collect on the Website. You hereby acknowledge that the personal information you provide to us will be managed in a systematic, automated manner using automated and any other information system tools.
Links to other websites
The website may contain links to other websites, plug-ins and social media sites. However, if you use a link and leave the Website, you should be aware that the Administrator has no control over other websites and therefore cannot be responsible for the protection and privacy of any information you provide when you visit such sites, and such sites are not covered by this Privacy Policy.
Providing Personal Information
Your personal data processed in connection with the organisation of races and sporting events is made available to the relevant staff and employees of the Administrator and to the representatives and staff of the companies we have engaged to technically process such data for us. These are entities that work as administrators of databases, IT networks, providers of services necessary for the realization of the races, such as providers of timekeeping, photographic and video services, commentators and other entities that may provide technical support.
Rights of data subjects
When collecting, processing and storing your personal data, the Administor shall take full care to protect your rights as they arise from the relevant provisions of the legislation. In connection with the processing of personal data, you are entitled to the rights specified below, which you may exercise at your discretion:
- the right of access to your personal data,
- the right to request the rectification, blocking or destruction of personal data if you believe or discover that we or third parties authorised by us are processing your personal data in a way that is contrary to the protection of your private and personal life or in breach of applicable law, in particular if your personal data is inaccurate in relation to the purpose of its processing,
- the right to erasure ("right to be forgotten"),
- the right to restrict the processing of your personal data,
- the right to object at any time to the processing of your personal data on grounds relating to your particular situation,
- the right to data portability,
- the right to withdraw your consent at any time (Withdrawal of your consent does not affect the lawfulness of processing based on consent given before its withdrawal.),
- the right to file a complaint against the processing of your personal data by the Administrator at the Office for Personal Data Protection, Pplk. Sochor 27, Postal Code 170 00, Prague 7, www.uoou.cz.
By submitting the registration form, you grant the Administrator consent in connection with your participation in the RunTour race, in accordance with the provisions of § 84 et seq. Civil Code, as amended, to the taking of your likeness, audio, visual or audio-visual recordings during the race and/or during the presentation of any prize that will be presented to you in person during the race (further referred to as "Image") and you consent to the use of the Image for commercial purposes via all communication media, regardless of their nature and purpose, by all usual means, their subsequent editing and their possible combination with other works or inclusion in a collective work. You grant this consent free of charge, without limitation as to subject matter, quantity, time or territory. This consent also applies to third parties to whom the Administrator provides the image in accordance with its purpose.
